Welcome to Tymira Health. These Terms of Use ("Terms") govern your access to and use of the websites, applications, and services (collectively, the "Services") provided by Tymira Health Limited ("Tymira Health," "we," "our," or "us").
By creating an account, accessing, or using our Services, you agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, you may not access or use our Services.
1. Description of Services
Tymira Health provides a technology platform designed to improve healthcare delivery and management. Our Services include, but are not limited to:
Tymira360: An all-in-one practice management platform for Healthcare Providers.
Patient Portal & Family Portal: A secure online portal for patients and their families to access health information and interact with their providers.
Telehealth Services: Tools that facilitate remote video and text-based consultations between Patients and Healthcare Providers.
Other related features for scheduling, billing, and health data management.
2. IMPORTANT MEDICAL DISCLAIMER
Tymira Health is a technology platform; we are not a healthcare provider, and we do not provide any medical advice.
The content and services provided by Tymira Health, including the AskTymira Chatbot and any AI-driven suggestions, are for informational and administrative purposes only. They are not a substitute for professional medical advice, diagnosis, or treatment from a qualified Healthcare Provider. Any doctor-patient relationship is strictly between you (as a patient) and the Healthcare Provider you consult with. Always seek the advice of your physician or other qualified health provider with any questions you may have regarding a medical condition. Never disregard professional medical advice or delay in seeking it because of something you have read or accessed through our Services.
In case of a medical emergency, please contact your local emergency services immediately.
3. User Accounts and Responsibilities
To use our Services, you must register for an account. You agree to provide accurate, current, and complete information during the registration process and to update such information to keep it accurate.
A. For Healthcare Providers (Clinics, Doctors, Dentists, Therapists, etc.):
You represent and warrant that you are a licensed and qualified healthcare professional in good standing within your jurisdiction.
You are solely responsible for the quality, accuracy, and legality of the medical advice and services you provide to Patients using our platform.
You are responsible for maintaining the confidentiality of your account login information and for all activities that occur under your account.
You agree to use the Services in compliance with all applicable laws, regulations, and professional ethical guidelines, including those related to patient data privacy.
B. For Patients and Users:
You are responsible for all activities that occur under your account.
You understand that the Healthcare Providers on the platform are independent professionals and that Tymira Health is not responsible for their services or advice.
You grant your Healthcare Provider the right to create and manage your health record within the Tymira360 platform for the purpose of your care.
4. Payments, Subscriptions, and Billing
For Healthcare Providers: Certain features of the Services may be subject to payment of fees, such as a monthly or annual subscription for using Tymira360. You agree to pay all applicable fees as described on our website. All fees are non-refundable, except as required by law.
For Patients: You may be required to pay for services rendered by Healthcare Providers through our platform. You agree to provide accurate payment information (e.g., M-Pesa, debit/credit card) and authorize us and our third-party payment processors to charge your payment method for the services you receive.
5. Acceptable Use Policy
You agree not to use the Services to:
Upload or transmit any content that is unlawful, harmful, or infringes on the rights of others.
Impersonate any person or entity or misrepresent your affiliation with a person or entity.
Attempt to gain unauthorized access to any portion of the Services or its related systems.
Use the platform for any purpose other than its intended use for healthcare management and consultation.
6. Intellectual Property
Our Intellectual Property: All content, trademarks, logos, and software associated with the Services are the exclusive property of Tymira Health Limited and its licensors. You may not copy, modify, or distribute any part of our Services without our prior written consent.
Your Data: You (or your Healthcare Provider, as applicable) retain all rights to the Personal Data and Health Data you provide. By using the Services, you grant us a license to use, process, and transmit this data as necessary to provide and improve the Services, as outlined in our Privacy Policy.
7. Termination
We may suspend or terminate your access to the Services at any time, without prior notice, for any reason, including, but not limited to, a breach of these Terms. You may deactivate your account at any time by contacting us.
8. Disclaimers and Limitation of Liability
THE SERVICES ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT ANY WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED.
TO THE FULLEST EXTENT PERMITTED BY LAW, IN NO EVENT WILL TYMIRA HEALTH, ITS AFFILIATES, OR THEIR LICENSORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM (I) YOUR ACCESS TO OR USE OF OR INABILITY TO ACCESS OR USE THE SERVICES; OR (II) ANY MEDICAL ADVICE OR TREATMENT PROVIDED BY A HEALTHCARE PROVIDER THROUGH THE SERVICES.
9. Governing Law and Dispute Resolution
These Terms shall be governed by and construed in accordance with the laws of the Republic of Kenya, without regard to its conflict of law provisions. Any dispute arising from these Terms shall be resolved through the competent courts in Nairobi, Kenya.
10. Changes to These Terms
We reserve the right to modify these Terms at any time. If we make material changes, we will provide you with notice through our Services or by other means. Your continued use of the Services after such notice constitutes your acceptance of the new Terms.
